Certain functionalities within the Helioq Pilot App are provided on a beta or pilot basis. These features may contain errors or bugs and may be subject to change, removal, or discontinuation at any time without notice.
We welcome feedback about these beta features. By submitting feedback, you grant Helioq a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, and create derivative works from your feedback for any purpose.
Subject to your compliance with these Terms, Helioq grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Helioq Pilot App for personal or internal business purposes.

Decompile, reverse-engineer, disassemble, or attempt to derive source code from the App.
Modify, adapt, translate, or create derivative works based on the App.
Use the App for unlawful, fraudulent, or malicious purposes.
Interfere with or disrupt the operation or security of the App or its associated servers and networks.
The App allows you to manage and add new Helioq NodeX servers, view NodeX stats (such as uptime, performance, and rewards), and perform certain administrative actions. You acknowledge that any configuration or operational decisions you make regarding Helioq NodeX servers are solely your responsibility.
Any data or metrics related to NodeX performance, including reward amounts or network statistics, are provided for informational purposes only. We do not guarantee the accuracy, timeliness, or completeness of such information.
You are solely responsible for ensuring that your operation of any Helioq NodeX server complies with all applicable laws, regulations, and third-party terms (e.g., network rules or hosting provider requirements).
The App includes functionality to view, claim, send, and receive cryptocurrencies associated with your Helioq NodeX servers. You acknowledge that cryptocurrency transactions are inherently risky and may be subject to significant price volatility, security incidents, and regulatory uncertainties.
Sole Responsibility: You are solely responsible for securing your private keys, seed phrases, passwords, and any other credentials used to access your crypto wallet.
No Custody: Helioq does not hold or control your private keys. We cannot access, recover, or reset your private keys if you lose them.
Risk of Loss: Any unauthorized access or loss of private keys, cryptocurrency, or wallet data is at your own risk. Helioq disclaims all liability for such losses.
It is your responsibility to verify the accuracy of recipient addresses, amounts, and any other transaction details before sending or receiving cryptocurrency. Cryptocurrency transactions are generally irreversible; if you send funds to the wrong address or network, Helioq is not liable for recovering those funds.
You are responsible for determining and fulfilling any tax obligations, reporting requirements, or other legal or regulatory obligations arising from your use of the App, including but not limited to any crypto transactions or NodeX rewards.
Certain functionalities may require you to create an account. You agree to provide accurate, complete, and up-to-date information. You are solely responsible for maintaining the confidentiality of your login credentials.
You agree to promptly notify Helioq of any unauthorized use of your account. We are not liable for any losses or damages arising from unauthorized use of your account, whether or not you have notified us.
In connection with your use of the App, you agree not to:
Upload, post, or transmit content that is illegal, harmful, or violates the rights of others.
Engage in any activity that disrupts or harms the App’s functionality, security, or user experience.
Attempt to bypass measures used to prevent or restrict access to the App.
Use the App for any form of market manipulation, money laundering, or fraudulent schemes.
We reserve the right, but do not undertake any obligation, to review content you submit and to remove or refuse to display any content we deem inappropriate or in violation of these Terms.
All intellectual property rights in the Helioq Pilot App (excluding user-generated content) are the exclusive property of Helioq Inc. or its licensors. Nothing in these Terms grants you ownership of any intellectual property in the App.

Upon termination, your right to use the App will cease immediately. Sections related to ownership, disclaimers, limitation of liability, indemnification, and dispute resolution shall survive any termination.
These Terms and any dispute arising from or related to these Terms or the App shall be governed by the laws of Malaysia, without regard to its conflict of laws principles.

4.1 Limited License Subject to these Terms, Helioq grants you a limited, non-exclusive, non-transferable license to use NodeX (including any software or firmware) solely for its intended purposes as defined by Helioq. 5.2 Software Updates & Maintenance Helioq may periodically release software or firmware updates for NodeX. You agree to install such updates promptly to ensure optimal performance and security. Failure to install updates may result in reduced functionality or security risks, for which you assume full responsibility.
5.3 NodeX Performance & Rewards In some deployments, NodeX may participate in a decentralized network, blockchain, or Web3 ecosystem. Any rewards or cryptocurrencies generated (e.g., “mining rewards,” “staking rewards,” “transaction fees”) are not guaranteed and may vary based on network conditions, NodeX performance, and other external factors beyond Helioq’s control.
5.4 Resource Consumption Operating NodeX may increase your usage of electricity, bandwidth, or other resources. You are solely responsible for any associated costs.
5.5 Backup & Data Protection You are responsible for backing up any data, configurations, or wallet credentials stored on or related to NodeX. Helioq is not liable for lost data or the inability to recover wallet access due to user negligence or hardware failure.
6.1 Volatility & Risk Cryptocurrencies and blockchain-based assets are subject to substantial volatility and uncertainty. You acknowledge that the value of any rewards or tokens earned from NodeX may fluctuate or become worthless, and Helioq has no control or liability regarding these fluctuations.
6.2 Regulatory Compliance Cryptocurrency and blockchain activities may be regulated in your jurisdiction. You are responsible for understanding and adhering to all applicable legal and regulatory requirements, including securities, money transmission, taxation, and anti-money laundering laws.
6.3 No Financial or Investment Advice Helioq does not provide any financial, investment, or legal advice. Any data or analytics provided by NodeX are for informational purposes only. You assume full responsibility for any decisions you make based on such information.
7.1 Ownership All intellectual property rights in NodeX (including software, documentation, and branding) belong to Helioq or our licensors. Nothing in these Terms transfers ownership of any Helioq intellectual property to you.
7.2 Feedback If you provide feedback, suggestions, or ideas regarding NodeX, you grant Helioq a non-exclusive, royalty-free, worldwide, irrevocable license to use, reproduce, modify, and otherwise incorporate such feedback into our products and services.

9.2 No Guaranteed Uptime or Rewards We do not guarantee NodeX’s uninterrupted or error-free operation, nor do we guarantee the accrual of any rewards, tokens, or cryptocurrencies.
9.3 External Integrations NodeX may interface with external networks, blockchain protocols, or third-party services. Helioq is not responsible for any failure, security breach, or downtime caused by these third-party integrations.
To the maximum extent permitted by law, Helioq, its affiliates, and their respective officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or related to your use (or inability to use) NodeX. In no event shall our cumulative liability exceed the amount you paid to Helioq (if any) for NodeX in the six (6) months preceding the event giving rise to liability.
